N.C.G.S. Section 84-10.1 provides that knowingly aiding or abetting another person in committing the unauthorized practice of law is unlawful and entitles those damaged to a private cause of action. Statewide Title, Inc. has not and will not aid and abet the unauthorized practice of law.
The drafting of legal instruments, such as a deed or deed of trust, which convey an interest in real property is the practice of law in North Carolina (N.C.G.S. Section 84-2.1). Statewide Title, Inc. personnel do not draft such legal instruments, but are often asked to assist in the recording of legal instruments and to provide standard forms of legal instruments for our attorney customers. Only an actual party to said instrument or a North Carolina licensed attorney on behalf of one of the parties can lawfully prepare a legal instrument.
