Claim of Mechanics’ Lien Action of Lien Enforcement - Effect Of Dismissal Without Prejudice

As we have pointed out in our 1996 seminar materials, if a lien claimant dismisses without prejudice his action of lien enforcement commenced pursuant to G.S. 44A-13(a) and refiles his action within one year of the dismissal, the refiled action is deemed to be within the 180 day lien enforcement period in G.S. 44A-13(a) and the claim of lien is not discharged under G.S. 44A-16(4). Newberry Metal Masters Fabricators, Inc v. Mitek Ind., 333 N.C. 250, 424 S.E. 2d 283 (1993). This legal principle, which might be changed by the General Assembly, is not known by all title examiners.
